Legal Framework

Hate crimes are legally addressed in the country’s Criminal Code, namely:

Section 216 of Act C

Violence against a member of a community targeted based on racial, ethnic, religious or other characteristics.

Section 332 of Act C

Incitement against a community, targeting acts that encourage violence, discrimination or hostility based on group identity.

Section 333 of Act C

Denial of historical crimes committed by totalitarian regimes.

Section 335 of Act C

Use of symbols associated with oppressive and totalitarian regimes.

Bias motivation

Bias motivation also acts as an aggravating circumstance for several different crimes.

Strategy for Victims Rights

Victim Support Act

Hungary follows a Victim Support Act, which was developed in 2005. Some criticisms have been pointed to this framework, since its definition of victim is dependent on legal residence status, also not extending to family members.

Moreover, Hungary does not have a specific strategy dedicated solely to hate crimes, posing significant gaps and challenges to effectively support victims of hate crime, especially when it comes to governmental support.
