Legal Framework

According to Italian law, hate crimes are not classified as a separate or autonomous offence, but rather as an aggravating circumstance, as outlined in Article 604 of the Criminal Code.

Moreover, the same article no. 604 criminalises propaganda and the incitement to discrimination based on racial, ethnic or religious grounds.

Despite not being autonomously legislated, the Italian Criminal Code aims to prevent the spread of hate-driven ideologies and reduce the likelihood of hate crimes by holding individuals accountable for actions that incite discrimination or violence against others.

Strategy for Victims’ Rights

Italy’s national strategy for victims’ rights is mostly based on European policy, aiming to ensure victims can access information, support services, legal assistance and compensation.

In this sense, the Strategy is structured around five main pillars:

Psychological Support

Compensation

Specialised Services

In terms of its implementation, the Strategy can and should be used both by governmental and non-governmental institutions.

Use of International and EU Frameworks

Legislative Decree No. 212/2015

Ensuring the main principles of the EU Directive 2012/29 are respected, this Legislative decree establishes the fundamental standards to ensure victims are provided with the correct rights, support and protection.

Moreover, and importantly, this decree allows victims to have an active role in the legal process.

However, Italy does not have a specific strategy dedicated solely to hate crimes.
